Dear Mrs. SAMANOVA,  

I refer to my letter to Commissioner António Vitorino datet 27. February 2004 and his reply 23. March 2004.

I also refer to my letter of 14. March 2004 to you. The European Parliament has not yet answered my petition of 21.12.2001 on Freedom of Information, but I appreciate that the European Parliament is no longer writing, that there is access to public documents in Germany (se petition), which was not true. In draft report 2003/2237(INI), 9 March 2004 (Chapter KK), the EU Parliament states: "The European Parliament notes that in Germany there is no law ensuring access to documents of public authorities at the national (i.e. federal) level and that only four of the federal states have enacted such legislation".

The EU Commission has answered, but seems not to do anything for progress and seems to want to continue to base itself on untrue assumptions about member states.

In EU "COM (2002) 247: Communication from the Commission - A project for the European Union" one can read: "the common recognition of these principles, which are now embodied in the Charter of Fundamental Rights, is the cornerstone of integration for everyone living in the Union."

However my letter of 27.2.2004 shows Germany does not recognize and respect the Charter of Fundamental Rights. Germany may be strong enough to abuse it's national sovereignty and block through it's influence in the EU Council that German citizens can enjoy fundamental rights.

However the EU Commission has a duty to give reliable and valid information about member states, not assumptions which have been disproved. A good administration does not lie.

I have collected an investigations about those responsible for the lack of Freedom of Information in Germany link here and will publish the results. That's what my complain is about.
