Dear Mrs. Uerpmann,

I refer to your letter of 25. October 2005. You inform that my E-mail of 15. October 2005 (dated 19.October 2005) was handed over to the ECHR. You inform that the ECHR is only for complaints based on the European Convention on Human Rights and Fundamental Freedoms. I understand that you did not understand why this letter was send to you. You are certainly wrong, assuming that I do not want to complain. Please add the E-mail of 15. October to my complaint filed 11. November 2005 by recorded letter.

I immigrated 5. February 1982 to the European "area of freedom, security and justice" with a "guarantee for the principles of democracy and respect for human rights, which will be guaranteed by the  Fundamental Rights Agency.

The European "area of freedom, security and justice" can be characterized by the Charter of Fundamental Rights of the EU giving Freedom of Information in Article 42, access to documents in Article 41 (2), the right to complain in Article 43 (Ombudsman) and the right to fair answers within reasonable time in Article 41 (1).

In protest against human right violations in Baden-Württembergs and Germany (which I tried to make pubic authorities aware of, but did not get an answer7) I gave also up my address in Germany 2002 1 (which I had since birth in 1948).

I complaint to the Federal Constitutional Court case 1 BvR 1981/05 1 about the sentence of the higher administrative court  (Oberverwaltungsgerichtes) OVG 1 L 42.05 of 30. May 2005. The constitutional court did not rule according to the European "area of freedom, security and justice" and does not give a guarantee to always be committed  to the TREATY ON EUROPEAN UNION, European Convention on Human Rights and Fundamental Freedoms (ECHRFF), International Covenant on Civil and Political Rights (ICCPR) and the Charter of Fundamental Rights of the EU . Therefore 11. November 2005 this case was brought to the ECHR.  In addition the UN Petition Team 4 was informed and the European Parliament (my "Home parliament") will be contacted 10. December 2005 6.

Most typical for the attitude to human rights in Germany is the German Institute of Human Rights (Deutsche Institut für Menschenrechte) which was founded on the basis of suggestions of the UN (UN resolution 48/134 of  20. December 1993) and CoE Recommendation No. R (97) 14. The first director Percy MacLean (now again judge at the Verwaltungsgericht Berlin) had to resign, because he monitored human rights in Germany (how UN wished). The opponents favoured to monitor international developments. Vision and reality: How to proceed?). Especially steering members Mrs. Dr. Hanna-Beate Schöpp-Schilling and Mrs. Barbara Unmüßig opposed to monitor human rights in Germany. Access to these documents about this has been denied. Since the German Institute of Human Rights is not allowed doing it, I did my own investigations on human rights violations in Germany7 :-)

The response to promotion of human rights is very hostile. Lawyers who are critical to the German legal system can be fired from the bar with the help of a monopoly dating back to a law on legal advice from 1935, which means a Berufsverbot. The German bar (Bundesrechtsanwaltskammer) is the secessor (see § 233 BRAO), of the Reichs-bar (Reichs-Rechtsanwaltskammerder) from 18. March 1933 and constituted (Reich-Rechtsanwaltsordnung) on 13. December 1935. The lawyers bar in Cologne tries (See Krumbiegel Scandal) to fire a lawyer, who promotes Human Rights and his clients interests in clear words. Since I live in Norway I have the possibility to promote human rights without having to fear difficulties. But although I am save I get the same reactions i. e. trial to use "the long arm of the Nazi-law" against me. If you had read my letter of 15 October 2005 you would understand. However German employees of the ECHR, who want to go back to Germany are in a different position.

I demand that my choice of the English language is respected.

I ask you to hand this case over to a non-German employee of the ECHR.
